Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website opanije.com and its online store (together, the "Site"), operated by Opanijé from Salvador, Bahia, Brazil. By using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
Opanijé is a Bahian percussion school and cultural project based in Salvador, Bahia, Brazil. You can reach us at [email protected].
The seller is Adson Vasconcelos dos Santos Junior — CNPJ 41.926.927/0001-34.
2. What we offer
- Free online course: our introductory percussion course is provided free of charge; access is delivered by email after you sign up.
- Paid online course: alongside the free course, we offer additional course content for purchase. Access to the paid content requires signing in with your Google account and is unlocked once payment is confirmed, processed by Mercado Pago. Once payment is confirmed, access to the purchased course is lifetime, subject to the refund and revocation terms described in Section 3.
- In-person classes: we run in-person percussion and dance classes in Salvador. Availability, scheduling and pricing are arranged on request via WhatsApp or email.
- Cultural immersion in Bahia: our Bahia immersion is sold through our online store; prices, inclusions and available dates are shown at the point of purchase.
- Consultations and bookings: free consultations and calls can be scheduled through our booking link or arranged over WhatsApp.
3. Orders, payments, pricing and the paid course
Purchases made through our store are processed by our payment providers, Stripe and PayPal. The paid course is processed separately, through Mercado Pago, in Brazilian reais (BRL). Prices, product descriptions and any applicable terms are those presented to you at checkout. We may correct errors and update prices and offerings at any time before you place an order.
Access to the paid course is lifetime from the moment payment is confirmed — it does not expire over time. Under article 49 of Brazil's Consumer Defense Code (CDC), because this is a purchase made outside a physical establishment (an online purchase), you have the right to withdraw within 7 (seven) calendar days of payment confirmation; if you do, the amount paid is refunded in full by Mercado Pago, to the same payment method you used, and the timing of the refund depends on your bank or card network. Outside that 7-day window, refunds and cancellations of the paid course follow the terms presented at checkout. If a payment is disputed (chargeback) or placed under review with Mercado Pago, access to the course may be revoked immediately, before the dispute is resolved. Refunds and cancellations for other store products are handled according to the terms presented at checkout for the relevant order.
4. Communications and personal data
When you sign up for the course, sign in with your Google account to access the paid course, contact us, or buy from the store, we handle your personal data as described in our Privacy Policy and Cookie Policy. Email is sent only for the purpose you agreed to; you can withdraw consent or unsubscribe at any time.
5. Intellectual property
All content on the Site — including text, images, video, audio, course materials, and the Opanijé name and marks — is owned by Opanijé or its contributors and is protected by law. You may view and use it for your own personal, non-commercial learning. You may not copy, redistribute, or reproduce it for other purposes without our written permission.
6. Content you submit
If you send us a message, testimonial, or other content, you confirm it is yours to share and you grant us permission to use it as described where you submitted it (for example, a testimonial you consent to have shown on the Site). We review submissions before publishing and publish nothing automatically.
7. Acceptable use
Please use the Site lawfully. Do not attempt to disrupt, attack, or gain unauthorised access to the Site, or use it to infringe the rights of others.
8. Third-party services
The Site relies on third-party services — including Stripe and PayPal (store payments), Mercado Pago (paid-course payment), Google (sign-in for paid-course access), Cloudflare Stream (course video playback), our scheduling and messaging tools, and analytics loaded only with your consent. Your use of those services is also subject to their own terms and privacy policies.
9. Disclaimers and limitation of liability
The Site and its content are provided "as is", without warranties of any kind. To the fullest extent permitted by applicable law, Opanijé is not liable for indirect or consequential losses arising from your use of the Site. Nothing in these Terms limits any rights you have under applicable consumer-protection law.
10. Changes to these Terms
We may update these Terms from time to time. The version in force is always the one published on this page, bearing the effective date above.
11. Governing law
These Terms are governed by the laws of Brazil. Any dispute will be subject to the courts of Salvador, Bahia, Brazil, without prejudice to any mandatory consumer rights.
